CAPTURED CONTENT INCLUDING IMAGES, GIFS, BOOMERANGS & VIDEOS ARE IMMEDIATELY POSTED ONLINE TO OUR LIVE GALLERY & WEBSITES.
Definitions
In this terms of use document, the following expressions are used and bear the meanings listed,
‘Person/s’ – means the person or people using the photo booth.
‘The Owner’ or ‘The Owner's’– means William C Gibson (ABN- 21180849721) trading under the Business name Snap Click Booth.
‘Captured Content’- means any portraits, pictures, gifs, boomerangs, videos, audio and any other content in which you may appear in whole or in part.
Terms of use
The Person/s that are using this photo booth device including the Person/s that are in the capture area of the photo booth must agree to the terms of use set out in this document. If you or any Person/s using the booth do not agree to the following terms please do not use the device.
USE OF CAPTURED CONTENT
The Person/s using the photo booth hereby grant The Owner the copyright and continuous unrestricted right and permission to license, use, reproduce, and distribute any Captured Content of you including but not limited to photographic portraits, pictures, gifs, boomerangs, videos, audio and any other content in which you may appear in whole or in part, in any country, at any time, in any media, for any purpose including but not limited to, print-based publications, web-based publications, marketing purposes including uploading the images to our website, social media pages, publishing promotional material, illustration, advertising, trade, or any other purpose, without payment or other consideration, as well as the right to use your contact information including but not limited to your email address and mobile phone number for promotional purposes, acknowledging that you may opt out of any communications in the future.
Copies of Captured Content and your contact details may also be provided to trusted third parties such as the original photo booth hirer or event organiser.
The Owner is not responsible for maintaining copies of any Captured Content.
Images and Content will be posted online
Captured Content including but not limited to photographic portraits, pictures, gifs, boomerangs, videos, audio and any other media are immediately uploaded and stored online on various publicly viewable platforms including online galley websites, social media websites and other 3rd party websites or cloud-based storage servers. Images will be stored and backed up on our servers, website and other 3rd party providers' web servers, websites and in cloud-based applications. To the full extent available by the law, The Owner takes no responsibility for third parties viewing or obtaining copies of the captured content.
Inappropriate Content
To the full extent available by the law, The Owner will not be held liable for any consequences or actions that occur in relation to the content in the images and Captured Content from an event. Any Captured Content that is deemed inappropriate may be discarded at The Owner's discretion.
To the full extent available by the law, the Person/s waives any right to a claim of breach of privacy, intellectual property infringement, or related claim that may occur or be produced in the taking of photographic content, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy. The Person/s discharges The Owner, from any liability, that may occur or be produced in the taking of photographic content, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.

Monitored Devices
Our photo booth devices are monitored. While using any of The Owners devices you may be recorded by the built-in camera and other surveillance cameras that may also be in use around the device. Our Devices are monitored by GPS Tracking. Please respect the equipment and treat it in an appropriate manner.
Mistreatment of attendants and equipment
The Owner employees or attendants are expected to work in a safe, non-abusive and non-hostile environment. Any mistreatment or abuse of the attendant, The Owner, equipment or anyone accompanying The Owner, in any way will result in the immediate discontinuation of services. The Owner employees or attendants may pause or terminate the use of the photo booth at any time during the event if they consider that any Person/s are behaving in a way that The Owner believes to be dangerous to themselves or any persons, or potentially damaging to The Owner's equipment or the venue.
The Owner reserves the right to exclude any Person/s from the photo booth if The Owner considers that Person/s to be dangerous to themselves or any persons, or potentially damaging to The Owner's equipment or the venue this includes guests that are grossly intoxicated or behaving in an aggressive or abusive manner towards The Owner, employees or attendants.
